Terms of Service

1. The service

tips.ke lets a tipper send money to a worker, a venue's staff, or a creator, by M-Pesa or card, without the tipper needing an account. Workers and venues sign up to receive tips and manage who they're shared with. By using tips.ke to send or receive a tip, or by creating an account, you agree to these terms.

2. Fees

A tipper pays exactly the amount they enter, no fee added on top. A 10% handling fee is deducted from each payout to a worker or venue; the rest is paid out automatically. See Pricing for the full breakdown.

3. Your account

You're responsible for your account and the tip link associated with it. A worker's or venue's account is tied to a verified M-Pesa number wherever that verification is available; keep your login methods (phone, Google, email and password) up to date so a lost phone never locks you out.

4. Payouts

A confirmed balance pays out automatically to the M-Pesa number linked to your account once it reaches the posted threshold. You're responsible for keeping that number correct and under your control. A payout that fails to reach you because the number on file is wrong or no longer yours is not tips.ke's liability.

5. Tips are voluntary and final

A tip is a voluntary payment for service already given, not a purchase. Once a tip is confirmed it's final and non-refundable, except where required by law or where tips.ke agrees to reverse it at its discretion (for example, a tip sent to the wrong person by mistake, reported promptly).

6. Acceptable use

Don't use tips.ke to:

• impersonate a worker, venue, or business you don't represent;
• solicit or pressure a customer into tipping;
• receive payment for anything other than a genuine tip or gratuity;
• circumvent the fee structure by routing payments outside the platform while presenting them as tips.ke transactions;
• probe, disrupt, or attempt to gain unauthorized access to the service.

We may suspend or close an account that does any of these.

7. Availability and liability

The service is provided "as is", without warranties of any kind. To the maximum extent permitted by law, tips.ke is not liable for indirect or consequential damages, lost profits, or a payout delayed or lost due to a third-party payment provider (M-Pesa, Paystack, or similar) outside our control. Our total liability for any claim is capped at the fees we earned from your account in the twelve months before the claim.

8. Termination

You can stop using tips.ke and close your account at any time; any confirmed balance owed to you is paid out first. We may suspend or terminate accounts that breach these terms, with notice where practical. Sections 5, 7, and 9 survive termination.

9. Changes to these terms

We may update these terms as the product evolves. Material changes will be posted here with an updated date, and announced in the dashboard where practical, at least 14 days before they take effect.

10. Governing law

These terms are governed by the laws of Kenya.
